私隐政策

卓珈指卓珈控股集团有限公司（「本公司」）及旗下品牌（包括CosMax、VITAE及XOVĒ）、附属公司、联营公司、控股公司以及关联公司及实体（以下统称为「我们」或「本集团」）。本私隐政策（「私隐政策」）适用于我们可能从以下各方获得的所有个人资料（不论现时或将来）： (i) 现有客户；及 (ii) 向我们提供个人资料并表示对我们的医学美容服务及护肤产品（以下统称为「服务及产品」，分别称为「产品」及「服务」）感兴趣的潜在客户。

请仔细阅读本私隐政策，以了解我们关于如何致力地保障  阁下的私隐及确保  阁下的个人资料（定义见下文）受到保护。 当我们收集  阁下的个人资料时，  阁下必须选择点击我们提供的复选框，以表明  阁下同意并了解本私隐政策。

本私隐政策可能会不时被修订或进行我们认为必要的其他更改，但我们将努力在可行的情况下提前通知  阁下任何此类修订或更改。

1.   阁下的私隐
我们尊重所有人的个人资料私隐，并承诺遵守香港法例第486章《个人资料（私隐）条例》（「私隐条例」）的规定，以确保  阁下的个人资料私隐依法得到保障。为此，我们要求所有员工以与私隐条例适用于本集团的方式遵守私隐条例，并遵守最严格的安全及保密标准。

2. 我们可能收集的个人资料类别
「个人资料」是指与一名在世人士有关及可确定个人身份的资料，亦必须以可供查閲及处理的方式记录下来。 我们可能会在以下项目／类别中收集  阁下的资讯：
2.1 关于  阁下的资料；
阁下的姓名、性别、年龄、出生日期、香港身份证号码／其他身份证明文件号码、电话号码、传真号码、居住地址、通讯地址、电邮地址、微信账号、社交媒体账号、签名、生物辨识数据及生物医学样本；
2.2 有关  阁下预约或使用我们的服务及／或产品资讯；
阁下的信用卡资料、生物医学样本、医疗纪录、医疗报告、医疗影像及医疗图片；
2.3 有关  阁下的关联组织、朋友或家庭成员；
组织的名称、  阁下于该组织的职位、  阁下于该组织的职员／会员号码、  阁下朋友或家庭成员的姓名、  阁下与该等朋友或家庭成员的关系、他们的香港身分证号码／其他身分证明文件号码、住宅地址、通讯地址、电邮地址及签名；
2.4 访问我们的网上平台时收集的资讯，包括网站、手机应用程式、社交媒体平台及／或我们通过线上与  阁下的沟通（请参阅8. Cookies 使用部份）；
IP 地址、浏览器设置、浏览纪录及／或其他互联网日志资讯；
2.5  阁下可能希望向我们提供的其他资讯；
阁下的职业、教育程度、入息水平、兴趣、活动喜好、社交媒体联繫方式以及  阁下可能随时披露的任何其他资讯。
请放心，我们可能不会收集上述提到的每一项个人资料，但我们获得  阁下的个人资料时会遵守本私隐政策。所收集所有个人资料将存置于我们的个人资料系统。
阁下如未满18岁，在向我们提供任何个人资料前，  阁下必须首先获得  阁下的父母或监护人同意。
虽然  阁下提供  阁下的个人资料乃属自愿而非必须，但如不提供此等个人资料，我们可能无法向  阁下提供某些服务及产品。

3. 收集个人资料的目的及用途
阁下的个人资料可能用于以下目的：
3.1 确定及验证  阁下註册成为我们的会员以及使用我们的服务及产品、会员优惠、重续及／或终止会籍的资格；
3.2 让我们能够存储  阁下的个人资料并识别重复的会员账户（如有），以及存储  阁下使用我们集团之服务及产品的记录；
3.3从  阁下代家人／朋友註册的账户以及  阁下自己的账户中识别  阁下；
3.4 让我们可为  阁下提供服务及产品、包括客户服务，例如预约及预订、处理投诉及客户查询、订单处理、处理保险索赔，以及处理付款指示或向  阁下收取我们提供的服务及产品、处理退款、药物测试及诊断、实验服务的未付款项；
3.5 根据  阁下的兴趣及偏好创建客制化的通讯，以便在使用我们的服务及产品时为  阁下提供最佳的客户体验。我们还可能利用资料分析工具来确定我们的优惠、广告及推广活动的有效性以及  阁下对新产品或服务的兴趣，以便为  阁下定制产品或服务；
3.6 通过各种方式优化我们的服务及产品、网站、手机应用程式及其他网上平台，包括但不限于使用资料分析工具、研究、调查及回应表格，以便我们可以审查及改进我们的业务、行销及策略运作及计划；
3.7 确定及验证  阁下是否有资格获得我们的服务及产品的折扣及促销；
3.8 直接促销我们的产品及服务，及本集团业务伙伴的产品及服务（详情见「5. 直接促销」一节）；
3.9让  阁下选择参与我们为  阁下提供的服务的互动功能，包括识别  阁下的朋友，并在  阁下愿意的情况下与他们沟通及分享  阁下的购物体验；
3.10防范及阻止欺诈；
3.11审计目的；
3.12按适用法律、规则及规例的规定作出披露；及
3.13 任何与收集个人身份识别资讯的原来目的有关之其他用途。
我们亦可能会将  阁下的个人资料变成为非个人身份识别资料，办法是将  阁下的个人身份识别资讯与其他个体的个人资料结合，或删除资料之中可识别  阁下的身份的特徵（例如  阁下的姓名）。我们可能会将该等非个人身份识别资料用于如研究及分析等目的，以改善我们的产品及服务。
若有需要，我们可能会将  阁下的个人资料转移至香港特别行政区以外的地方，以达到收集此等资料之目的，或直接与其有关之目的。 任何有关的资料转移都会遵照私隐条例之规定及约束。

4. 个人资料披露
所有个人资料都将保密，但我们可能会向第三方披露此类信息，以实现上文第 3 条所述的一项或多项目的。 我们向  阁下收集的个人资料可能转交予以下名单的第三方（可能位于香港境内或境外）：
4.1 第三方服务提供商，包括代理及承包商；
4.2卓珈及旗下任何品牌、附属公司、联营公司、控股公司以及关联公司及实体；
4.3我们业务的全部或任何部分的购买者；
4.4 我们的专业顾问、保险公司、损失理算师及康復服务提供商；
4.5政府、执法机关、法院及审裁署；
4.6 阁下授权向我们获取  阁下的个人资料的任何第三方。

5. 直接促销
我们可能不时使用  阁下向我们提供的个人资料向  阁下发送消息、优惠、宣传及联合市场推广，就此而言，我们必须要取得  阁下的事先书面同意。
我们可能使用  阁下的个人资料进行的直接促销活动类型包括向  阁下提供与本集团有关的新闻、活动、更新、竞赛、折扣、促销、优惠资料及详细资讯，例如我们及我们的业务伙伴提供的服务及产品及／或奖励，可能涉及美容、健康及保健、个人护理、护肤、医学美容服务、宠物护理、婴儿护理、产妇护理、生活、旅游、技术、幸运抽奖及竞赛、媒体、电子商务服务及奖励计划。
我们将通过各种通讯渠道，如直接邮寄、电子邮件、电话、短讯、应用程式通知、社交媒体及文字／图片／视频资讯，使用我们持有的  阁下的个人资料来实现此一目标。 未经  阁下事先书面同意的情况下，我们将不会把  阁下的个人资料用于直接促销。
我们将分析  阁下的偏好、线上行为及交易歷史以获得深入瞭解，从而使我们能够制定我们透过通讯、线上平台、社交媒体及其他通讯方式向  阁下展示的新闻、活动、更新、竞赛、促销、优惠、产品、服务及奖励的内容及类型。
如  阁下不希望我们将  阁下的个人资料用于直接促销，  阁下可以在提供  阁下的个人资料时勾选相关的方框表示反对。
如  阁下希望在未来任何时候取消接收我们的直接促销资料，请将  阁下的英文或中文全名及会员号码发送至卓珈控股集团有限公司客户服务经理，地址为香港中环干诺道中88号南丰大厦18楼，或电邮至info@cosmax.com.hk，表明  阁下希望取消接收我们使用  阁下的个人资料提供的直接促销资料。 在收到该请求后，我们将在实际可行的情况下尽快停止使用  阁下的个人资料进行直接促销，而不收取额外费用。

6. 保留个人资料
我们对  阁下的个人资料的保存时间将不会超过实现资料被使用或将被使用之目的（包括任何直接相关目的）所需的时间。 这意味着，举例而言，为实现  阁下所要求的产品及服务而收集的个人资料，将在有关产品及服务交付后，透过採用技术或其他方法予以清除、删除、销毁或匿名处理，以令有关资料不可识别或不可用，除非出于其他目的有必要保留有关资料且我们在收集个人身份识别资料之时已经知会  阁下有关其他目的或已取得  阁下同意。

7. 查阅及更正个人资料
阁下可以在任何时候要求查阅及更正  阁下的个人资料。
阁下如欲要求查阅阁下的个人资料，可致函我们的客户服务经理。根据私隐条例第19(1)条，我们有责任在收到有关要求后40天内回应要求。根据私隐条例第20(3a)条条文，如要求不是以中文或英文书写，我们保留权利拒绝满足  阁下的查阅要求。根据该条例第28条，我们可就处理及遵从  阁下的查阅个人资料要求收取合理费用。
阁下如欲对  阁下的个人资料进行任何修改，可致函我们的客户服务经理，并提供正确的个人资料供我们更新。根据私隐条例第23条条文，我们将在收到  阁下要求后40天内更正  阁下的个人资料。更正个人资料将不收取费用。

6. 使用「曲奇」档案 (COOKIES)
「曲奇」档案是当  阁下进入我们网站及应用程式时储存于  阁下的浏览器或装置、应用程式、网上媒体或广告的小型文字档。 我们在本网站使用「曲奇」档案，以便：
- 在  阁下浏览本网站及流动应用程式时辨认  阁下的身分；
- 取得有关  阁下喜好的资料、查阅及浏览行为、网上活动及互联网的使用情况；
- 持续追踪  阁下户口内储存的项目，协助  阁下通过结账的手续；
- 进行研究及统计分析，协助我们改善服务，更瞭解访客及访客的要求及兴趣;
- 提供切合  阁下个人兴趣的广告，更有效地进行我们的促销及广告计划；
- 使  阁下的网上活动更有效率，体验更佳；
- 使安全措施更严密。

我们使用「曲奇」档案取得的资料可能不含  阁下的个人身份识别资料。 尽管我们可能取得  阁下的电脑或其他电子设备的资料（如IP地址、浏览器设定、浏览纪录及／或其他互联网纪录资料），但未必可以识别  阁下的身份。 由于非个人身份识别资料与个人身份识别资料有可能混合，就本私隐政策而言，我们视有关资料为个人资料。
假如  阁下不允许「曲奇」档案的使用，可在  阁下的互联网浏览器及电子装置上作出调整。 如  阁下停用「曲奇」档案，即表明  阁下知道可能无法使用我们网站及应用程式的某些功能。

9. 安全措施
阁下的个人资料安全及保密对我们来说是极其重要的。 我们会尽一切努力保护  阁下的个人资料。 我们已实施技术、行政及一切合理且实质的安全措施来保护  阁下的资料，防止他人未经授权存取该等资料及对该等资料作不当使用、披露及／或应用。这些措施包括﹔
9.1对相关职员进行教育及培训，确保他们在处理个人资料时瞭解我们保障个人私隐的义务；
9.2通过行政及技术控制，在 "有需要知道 "的基础上限制对个人资料的使用；
9.3技术安全措施，包括防火墙、加密及防毒软体；以及
9.4物理安全措施，例如职员进入我们的工作场所需要通行许可。
我们会不时地审查我们的保安程序，以考虑适当的新技术及方法。尽管我们在收到  阁下的个人资料后会採取适当的安全措施，但在互联网上（包括通过电子邮件）传输资料永远不会绝对安全。我们努力保护个人资料，但我们不能保证传输给我们或由我们传输的资料的安全性。

10. 本私隐政策的任何修订
我们可能会随时修订本私隐政策，以反映新技术、监管要求或任何可能需要的更改。 我们可能会通过向  阁下提供给我们的最新电子邮件地址向  阁下发送电子邮件，及／或通过在我们的网站上清晰刊登变更通知。

本私隐政策的条款受中华人民共和国香港特别行政区的法律监管并依其诠释。

于任何情况下，如中英版本有任何抵触或不相符之处，则以英文版本为准。

Privacy Policy
Miricor refers to Miricor Enterprises Holdings Limited (the “Company”) and its brands (including CosMax,  VITAE & XOVĒ), subsidiaries, associated companies, holding companies, and affiliated companies and entities (hereafter collectively referred to as “we”, “us” “our”, or the “Group”). This privacy policy (“Privacy Policy”) applies to all personal data that we may obtain from the following parties: (i) current customers; and (ii) potential customers who provide personal data to us while indicating their interest in our medical aesthetic services and skin-care products (hereinafter collectively referred to as “Services and Products” and individually as “Services” and “Products”).

Please read this Privacy Policy carefully to understand the policy and practices of our Group regarding how we are committed to safeguarding your privacy and ensuring that your Personal Data (as hereinafter defined) is protected. You must check the boxes when provided when we are collecting your Personal Data to indicate your consent to and knowledge of this Privacy Policy.

This Privacy Policy may from time to time be revised, or otherwise changed as we deem necessary but we will endeavour to give you advance notice of any such revision or change where practicable.

1. Your Privacy
We respect the personal data privacy of all individuals and pledge to be in compliance with the requirements of the Personal Data (Privacy) Ordinance (Chapter 486 of the Laws of Hong Kong) (“PDPO”) so that the privacy of your personal data is protected in accordance with the standard required by law. In doing so, we require all our staff to comply with the PDPO in the same manner as the PDPO applies to us as a whole and adhere to the strictest standards of security and confidentiality.

2. Type of Personal Data that may be collected by us
“Personal Data” is information that relates to an identified or identifiable individual. We may collect your information in the following categories:

2.1. Information about you:
Your name, gender, age, date of birth, HKID card/other identification document number, phone number, fax number, residential address, corresponding address, email address, Wechat account, social media accounts, signature, biometrics data, and biomedical specimens;
2.2. Information to process your order or use of our Services and/or Products:
Your credit card information, bio-medical data, medical records, medical reports, medical images, and medical photos;
2.3. Information relating to your associated organisation, friend(s), or family member(s):
The name of the organisation, title in the organisation, your staff/membership number of such organisation, the name of your friend(s) or family member(s), your relationship with the friend(s) or family member(s), their HKID card/other identification document number(s), phone number, fax number, residential address, corresponding address, email address, and signature;
2.4. Information collected when visiting our online platforms including websites, mobile applications, social media platforms and/or any online communication between you and us (see section 8. Use of Cookies below)
IP address, browser settings, browsing records, and/or other Internet log information;
2.5. Additional information you may wish to provide us with:
Your occupation, education level, income level, hobbies, favourite activities, social media contacts, and any other information you may disclose at any time.
Please be assured that we may not collect every single Personal Data or information mentioned hereinabove but all Personal Data or information we obtained shall be subject to this Privacy Policy. All Personal Data collected will be stored within our personal data system.

If you are under 18 years old, you must first obtain the consent of your parent or guardian before providing any of your Personal Data to us.

Whilst it is voluntary, and not obligatory, for you to provide such Personal Data, we may not be able to provide certain Services and Products to you in the event that such Personal Data is not provided.

3. Purposes for which your Personal Data will be used
The purposes for which your Personal Data may be used are as follows:

3.1. to determine and verify your eligibility for registering for our membership and using our Services and Products, eligibility for our membership offers, renewal and/or termination of membership;
3.2. to enable us to store your Personal Data and identify possible multiple applications and obtain records of your use of our Services and Products across the Group from time to time;
3.3. to identify you and any accounts you hold with us on behalf of your family members and/or friends;
3.4. to enable the provision of our Services and Products to you, including customer services such as making appointments and reservation, handling complaints and customer enquiries, order processing,  processing of insurance claims, and processing of payment instructions or collection of amounts outstanding from you in relation to the provision of our Services and Products, processing of refunds, medical testing and diagnosis, laboratory services including testing services etc.;
3.5. to create customised communications according to your interests and preferences so as to give you the best client experience while using our Services and Products. We may also make use of data analytics tools to determine the effectiveness of our offers, advertisements and promotions and your interest in new products or services so as to customise the Products or Services to be presented to you;
3.6. to optimise our Services and Products, websites, mobile applications and other online platforms through various means including but not limited to the use of data analytics tools, research, surveys and feedback forms so that we may review and improve our business, marketing and strategic operations and plans;
3.7. to determine and verify your eligibility for discounts and promotions on our Services and Products;
3.8. as direct marketing of our Services and Products or services and products of our business partners subject to the section headed “5. Direct Marketing” below;
3.9. to enable you to participate in the interactive features of our Services, including identifying your friends or individuals, and sharing or communicating with them your shopping experience at your own will;
3.10. as fraud prevention and detection;
3.11. for auditing purposes;
3.12. to make such disclosures as required by applicable laws, rules, and regulations; and
3.13. for all other purposes ancillary to the above purposes.

We may also take your Personal Data and make it unidentifiable, either by combining it with information of other individuals or by removing any identifiable information from your Personal Data (such as your name) for, among other purposes, research and analysis to improve our provision of Services and Products.
If necessary, we may transfer your Personal Data to places outside of Hong Kong for carrying out the purposes, or for the directly related purposes, for which the Personal Data is to be collected. All such transfers will be carried out in compliance with the requirements of the PDPO.

4. Disclosure
All Personal Data will be kept confidential, but we may disclose such information to third parties where such disclosure is necessary to fulfill one or more of the purposes as described in section 3 hereinabove. A list of classes of persons (who may be located within or outside Hong Kong) to whom your Personal Data may be transferred can be found in the list below:

4.1 Third service providers, including agents and contractors;
4.2 Miricor and any of its brands, subsidiaries, associated companies, holding companies, and affiliated companies and entities;
4.3 Purchaser of a whole or any part of our businesses; 
4.4 Our professional advisors, insurers, loss adjudicators, and assignees;
4.5 Governments, law enforcement authorities, courts, and tribunals; and
4.6 Any third party whom you have authorised to obtain your Personal Data from the Group.

5. Direct Marketing
From time to time, we may use your Personal Data to send you news, offers, promotions, and joint marketing offers but we must obtain your prior written consent for the purposes mentioned hereinabove.
The types of direct marketing activities that we may conduct using your Personal Data include providing you with information and details in connection with the latest news, events, updates, contests, discounts, promotions, offers, Products, Services and/or rewards offered by us and our business partners, which may  relate to beauty, healthcare and wellness, personal care, skin care, medical aesthetic services, pet care, baby care, maternity care, lifestyle, travel, technology, lucky draws and contests, media, e-commerce services and reward programmes.
We will do this through various communication channels such as direct mail, email, telephone, SMS, mobile applications notifications, social media, and text/ picture/ video messages by using your Personal Data held by us. We will not use your Personal Data in direct marketing without your prior written consent.
We will analyse your preferences, online behaviour and transactional history in order to gain insights, so that we can customise the content and types of news, events, updates, contests, promotions, offers, products, services and rewards that we present to you via our communications, online platforms, social media and other communication means.
If you do not wish us to use your Personal Data in direct marketing, you may indicate your objection by checking the box when providing your Personal Data.
If you wish to opt-out of direct marketing from us anytime in the future, please mail your English or Chinese full name and membership number to Miricor Enterprises Holdings Limited attention to Customer Service Manager, at 18/F, Nan Fung Tower, 88 Connaught Road Central, Central, Hong Kong or by email at info@cosmax.com.hk indicating that you wish to opt-out from us using your Personal Data in direct marketing. Upon receipt of the request, we shall cease to use your Personal Data for the purpose of direct marketing as soon as practicable without extra charges.

6. Retention of Personal Data
We will keep your Personal Data for as long as necessary to fulfill the purposes for which your Personal Data was collected or for a directly related purpose. This means that, for example, Personal Data collected to fulfill your request for Services and Products will be erased, deleted, destroyed or anonymised after their delivery by using technical or other means to render such information unidentifiable or unusable, unless it is necessary to keep such information for other purposes and we have informed you of such other purposes at the time of collection of your Personal Data or obtained your consent.

7. Access to and Correction of your Personal Data
You may, at any time, request access to and correction of your Personal Data. 
To request access to your Personal Data, you may write to our Customer Service Manager. Pursuant to section 19 (1) of the PDPO, we are obliged with such request within 40 days after receiving such request. In accordance with the provisions of section 20 (3a) of the PDPO, if the request is not written in Chinese or English, we reserve the right to refuse to comply with your access request. Under section 28 of the Ordinance, we may charge a reasonable fee for processing and complying with your Personal Data access request.
If you wish to make any changes to your Personal Data, you may write to our Customer Service Manager and provide the correct Personal Data for us to update. In accordance with the provisions of section 23 of the PDPO, we will correct your Personal Data within 40 days upon receipt of your request. Correction of your Personal Data will not be charged.

8. Use of Cookies
Cookies are small text files that are stored on your browser or device by websites, applications, online media and advertisements when you visit or access our websites and/or applications. We use cookies on such platforms to:
• recognise you whenever you visit our websites and/or mobile applications;
• obtain information about your preferences, viewing and browsing behaviour, online movements, and use of the Internet;
• keep track of the items stored in your account and take you through the checkout process;
• carry out research and statistical analysis to help improve our Services and Products and to help us better understand our visitor and customer requirements and interests;
• target our marketing and advertising campaigns more effectively by providing interest-based advertisements that are personalised to your interests;
• make your online experience more efficient and enjoyable; and
• enable tighter security.
The information we obtain from our use of cookies may not contain your Personal Data. Although we may obtain information about your computer or other electronic devices such as IP address, browser settings, browsing records, and/or other Internet log information, this may not be able to identify you personally. To the extent that such non-identifiable data is combined with your Personal Data, we treat the combined information as Personal Data for the purposes of this Privacy Policy.
If you want to disallow the use of cookies, you can do so on your own web browser or electronic devices. If you disable cookies, you acknowledge that you may not be able to use some of the functionality of our websites and/or applications.

9. Security
The security and confidentially of your Personal Data are extremely important to us. We will take all appropriate steps to protect your Personal Data. We have implemented technical, physical, administrative, and all reasonable and practicable measures to protect your Personal Data from any unauthorised access, disclosure, use and modification. These measures include:
9.1. Education and training to relevant staff to ensure they are aware of our privacy obligations when handling Personal Data;
9.2. Administrative and technical controls to restrict access to Personal Data on a “need-to-know” basis;
9.3. Technological security measures, including fire walls, encryption and anti-virus software; and
9.4. Physical security measures, such as staff security passes to access our premises.
From time to time, we review our security procedures in order to consider appropriate new technology and methods. Although we use appropriate security measures once we have received your Personal Data, the transmission of data over the internet (including by e-mail) is never completely secured. We endeavour to protect personal information, but we cannot guarantee the security of data transmitted to us or by us.

10. Amendment(s) to this Privacy Policy
We may from time to time amend this Privacy Policy to reflect new technologies, regulatory requirements, or any changes that may be necessary. We may notify you of such changes by sending you an email at the latest email address that you provided to us, and/or by prominently posting notice of such changes on our website.
